Conscious Branding LLC maintains this website (“Site”), its proprietary content, any courses offered by contributing partners or third-parties and other linked and related sites (“Provider”) for the use of its customers, students, contributing partners and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Conscious Branding LLC If you do not agree to these terms, do not use this Site.
1. Use of Site
Conscious Branding LLC provides various materials, including but not limited to video, audio, transcripts, workbooks, worksheets, surveys, quizzes, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Conscious Branding LLC authorizes each User to view and download one copy of the Materials for their use only and a maximum of one copy of the Materials may be printed, provided that Users make no modifications to the Materials and Conscious Branding LLC and Providers retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site and may be subject the User to legal action.
2. User Warranty
As a User you warrant that you are not an agent or employee of any other branding, marketing, coaching, business consulting or training company and the Site and Materials are solely for the purpose of the User as it relates to the development of their business.
3. Trademark and Copyright
Thrive! By Conscious Branding, and certain other brands, trademarks, and service marks, are marks of Conscious Branding LLC and its Providers. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.
5. Hyperlinks
Links to external websites are provided solely as a convenience to you. Conscious Branding LLC has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
6. No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Conscious Branding LLC further does not warrant the accuracy and completeness of the Materials at this Site. Conscious Branding LLC may make changes to the Materials at this Site, Providers or to the services and prices described in them, at any time without notice.
7. Satisfaction Guarantee
Conscious Branding LLC strongly believes the User will be fully satisfied with the content, toolset and expertise provided through its resource center. Upon completion of a course, if the User is not fully satisfied with the expertise and insight provided, and User can show they have participated fully and have fully applied the actionable knowledge and toolset gained, a full refund may be requested. To receive a refund, the User must have demonstrated good faith and meet the following conditions:
- Actively participated in available interaction forums, including course discussions and live coaching sessions if a required and available resource
- Complete the full course, including all lessons, workbook assignments, viewing of video content and all other required course-specific exercises and assignments
- Complete a one-to-one meeting with the instructor to address concerns and provide insights into why they are not satisfied with the course content and toolset
The request for a full refund must be submitted in writing once all conditions above have been satisfied. Written refund requests must be submitted to [email protected]
8. Limitation of Liability
In no event will Conscious Branding LLC, its Providers, or other third parties mentioned at this Site shall be liable for any lost data or content, lost profits, business interruption or for any indirect, incidental, special, consequential, exemplary or punitive damages arising out of or relating to the materials or the services provided by provider, even if provider has been advised of the possibility of such damages, and notwithstanding the failure of essential purpose of any limited remedy. Nor shall be liable for any damages whatsoever (including, without limitation, those resulting misdirection, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.
9. Applicable Law
The Terms of Use are governed by the laws of the State of Minnesota, United States of America. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Conscious Branding LLC may assign its rights and duties under the Terms of Use without notice to any party at any time. All disputes hereunder shall be first submitted to mediation within 30 days of notice of dispute by either party, and if not resolved thereby, shall be submitted exclusively to binding arbitration by an arbitrator selected by agreement of the parties’ counsel.
10. Class Action Waiver
In the event of a dispute, the User must resolve the dispute on an individual basis and may not bring a claim as a plaintiff or member in a class action. Class actions, general claim actions by private attorney or other consolidated actions and/or arbitrations are not allowed, unless all relevant parties specifically agree to do so.
11. Effective Date and Updates
The Terms are effective as of July 1, 2020 and are subject to change without notice by Conscious Branding LLC at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
